What Is Legionella and Why Does It Matter in Water?
Legionella pneumophila is the bacterium responsible for Legionnaires' disease, a potentially fatal form of pneumonia. It thrives in water systems where temperatures sit between 20°C and 45°C, water stagnates, and nutrients such as scale, rust or biofilm are present. When contaminated water is aerosolised — through showers, cooling towers, fountains or spray taps — and inhaled, infection can result.

The Regulatory Framework
L8 Approved Code of Practice (ACoP)
The HSE's Approved Code of Practice L8 — "Legionnaires' Disease: The Control of Legionella Bacteria in Water Systems" — is the primary regulatory document governing legionella management in the UK. It sets out the legal duties of duty holders (employers and those in control of premises) and defines the minimum standard of care expected. Failure to follow L8 ACoP guidance is not automatically a criminal offence, but it is taken as evidence that a duty holder has failed to meet the required standard.
HSG274
The HSE's technical guidance document HSG274 provides supplementary guidance in three parts: Part 1 covers evaporative cooling systems, Part 2 covers hot and cold water systems, and Part 3 covers other risk systems including spa pools, vehicle wash systems and water features. For water sector operators managing large and complex assets, HSG274 Part 2 is typically the most directly relevant.
Water Industry Act 1991 and the Water Supply (Water Quality) Regulations
Water companies operating under the Water Industry Act 1991 have a statutory duty to supply wholesome water. The Water Supply (Water Quality) Regulations 2016 (England) and equivalent Welsh regulations set out microbiological standards — legionella is addressed within the broader framework of microbiological quality monitoring. Drinking Water Inspectorate (DWI) oversight provides the regulatory assurance layer for supply-side legionella risk.

What Does Legionella Risk Management Involve?
A compliant legionella management programme under L8 ACoP involves several interconnected activities:
- Risk assessment: Systematic identification and evaluation of all water systems on site, including schematic drawings, temperature monitoring and assessment of risk factors. Must be carried out by a competent person and reviewed when circumstances change or at least every two years.
- Written scheme of control: A documented control scheme based on the risk assessment, setting out the control measures, responsible persons and monitoring frequencies for each system.
- Routine monitoring and testing: Temperature monitoring of hot and cold water systems, microbiological sampling (including Legionella culture testing), chemical analysis for cooling systems, and documentation of all results.
- Cleaning and disinfection: Periodic cleaning and chemical disinfection of systems, including thermal disinfection, chlorination or use of biocides as appropriate. Essential following any system repair, refurbishment or period of reduced use.
- Record keeping: L8 requires detailed records to be maintained — monitoring logs, service records, risk assessments and control schemes — for at least five years.
- Training and competency: Duty holders must ensure that all staff with legionella management responsibilities are appropriately trained. Water hygiene training, BOHS P901/W001 qualifications and Legionella Control Association (LCA) accreditation are widely recognised benchmarks.

The AMP8 investment cycle (2025–2030) is generating significant capital activity across the water sector — new treatment works, pumping station upgrades, network improvements and major infrastructure projects.
