What This Is

Scottish Water has published a legal services framework agreement (notice reference 2026/S 000-065141) on Find a Tender, seeking law firms to provide specialist legal support across four distinct practice areas. The framework runs for an initial four-year term with the option to extend for a further four years — up to eight years in total.

Most water sector legal work in Scotland never makes it to public tender. This notice is a rare open window — and it closes fast. The PSQ submission deadline is 11 August 2026 at 12:00pm, which means qualifying firms need to act within days, not weeks.

Acquisition, disposal and management of land and property assets. Relevant to Scottish Water's ongoing capital investment programme and network expansion across Scotland.

Commercial
£6.6m

The largest lot. Covers commercial contracts, procurement, supply chain agreements and general commercial advisory work across Scottish Water's operations and capital programmes.

Lot 3
Litigation & Employment
£4.0m

Dispute resolution, regulatory enforcement matters, employment law and tribunal representation. Regulated utilities face a consistent flow of litigation across operational and employment areas.

Lot 4
Governance & Regulatory
£0.9m

Corporate governance, regulatory compliance, and advisory work relating to Scottish Water's obligations to the Water Industry Commission for Scotland (WICS) and other regulators.

Firms may apply for one or more lots. There is no requirement to bid across all four areas.

Scots Law — Why It Matters

Scotland operates a distinct legal system from England and Wales. Scots law is derived from a different tradition — rooted in Roman law and Scots common law — and differs materially from English common law in areas including property, contract formation, and court procedure. Any firm seeking to participate in this framework must have genuine Scots law capability, either through a Scottish office, a qualified Scottish solicitor, or a formal arrangement with a Scottish law firm.

For firms already active in Scotland, this is immediately relevant. For English and Welsh firms without a Scottish presence, this is a decision point — either build or partner before the deadline.

Jurisdiction note

Scottish Water is headquartered in Dunfermline, Fife. All work under this framework will fall under Scots law jurisdiction. Firms regulated solely by the Solicitors Regulation Authority (England and Wales) would need to satisfy themselves of their ability to practise in Scotland before bidding.

Firms not already registered on the Atamis platform should register immediately — portal registration can take time and must be completed before a PSQ submission can be made.

The PSQ deadline is 11 August 2026 at 12:00pm. Late submissions will not be accepted.
